Terms & Conditions
In order to use the site, you must be registered with Recruitment Select.
All individuals registering company/business details with Recruitment Select hereby state that they have lawful authority and permission to act on behalf of the company/business for which they are registering. Registered advertisers shall be given a Recruitment Select member’s account for which they must select a username and password.
Advertisers are solely responsible for the security of their user name and password and for all activity of their account. Advertisers agree to accept responsibility for all activities that occur via their account or password. Recruitment Select will not be liable for any misuse of advertisers member accounts.
Advertisers may change their password or login at any time via their account homepage.
Advertisers agree to immediately notify Recruitment Select of any unauthorized use of their login name or of any other breach of security.
All posted job ads stay active for a maximum of thirty days (from the date of posting).
Advertisers wishing to renew an already posted job ad must repost the ad (such reposting is subject to appropriate charges).
Advertisers may remove a posted ad at any time prior to the thirty day expiry deadline. If an ad is removed prior to the thirty day expiry date, the ad is considered expired.
Advertisers may request from Recruitment Select that changes be made to any posted job ad’s job title, job category, location, work type, body copy or advertiser contact details. Recruitment Select will only grant and make such changes to job ads in the event that incorrect or inaccurate information has been mistakenly posted.
Recruitment Select reserves the right to cancel any advertiser’s membership account at any time and for any appropriate reason.
Recruitment Select reserves the right to refuse service, remove or edit content, or cancel orders made by any advertiser at Recruitment Select’s sole discretion.
As a condition of using services provided by Recruitment Select, advertisers agree to comply with the human rights and equal opportunity commission act 1986 (c´th) and all anti-discrimination and equal opportunity legislation applicable in the state or territory in which they conduct business.
If an exemption to comply with the human rights and equal opportunity commission act 1986 (c´th) has been granted, advertiser must include the exemption number in the job advertisement submitted to Recruitment Select.
Recruitment Select will not accept advertisements that appear to be contrary to law- in particular ads for work involving sex, nudity or possible criminal activity.
Recruitment Select reserves the right to withdraw without notice to the advertiser any advertisement that is or appears to Recruitment Select to be contrary to law.
Recruitment Select reserves the right to remove, delete or reject any advertisement from its site for any reason whatsoever.
Advertisers agree to indemnify Recruitment Select, its officers, employees and agents against all claims, actions, suits, liabilities, costs and expenses incurred on any account by Recruitment Select as a result of the listing or proposed listing of any advertisement by an advertiser on the site.
Recruitment Select cannot and does not guarantee or warrant to the advertiser that files available for downloading through the site or delivered via electronic mail through the site will be free of infection or viruses, worms, trojan horses or other code that manifest contaminating or destructive properties.
Advertisers are responsible for implementing sufficient procedures and checkpoints to satisfy their particular requirements for accuracy of data input and output, and for maintaining a means external to the site for the reconstruction of any lost data.
Recruitment Select provides no warranty to advertisers that services generally available through the site will be uninterrupted or error free. Recruitment Select agrees to use reasonable endeavor to ensure that any disruptions to or a denial of access to the site will be remedied as quickly as possible.
Recruitment Select makes every effort to avoid errors in job advertisements it has agreed to post on the site. However, Recruitment Select accepts no liability for any errors and requires that advertisers check their advertisements for errors as soon as they are posted on the site. All reasonable efforts will be undertaken by Recruitment Select to edit errors brought to our attention as soon as possible.
Recruitment Select agrees to use every reasonable effort to publish advertisements in the shortest possible time frame. Recruitment Select is not liable for any loss or damage incurred by an advertiser as a result of any failure or delay in listing an advertisement.
Advertisers agree at all times to deal with any information or products provided by Recruitment Select or accessed from the site in a manner which abides by all applicable laws of Australia, or of any other relevant jurisdiction (including, without limitation, privacy and copyright laws).
Recruitment Select forbids advertisers from using the site for the purposes of posting job advertisements relating to any franchise, pyramid scheme, "club membership", multi-level marketing, distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (no significant salary) or requires recruitment of others including, but not limited to, members, sub-distributors or sub-agents.
Advertisers agree to only place job ads for positions for which they have permission to recruit.
Advertisers agree to keep Recruitment Select its officers, employees and agents fully indemnified against any actual or contingent liabilities incurred in relation to any actions or claims brought by any person or entity against Recruitment Select as a result of an actual or alleged breach by you of any law, or such other actions or claims brought in relation to the provision of services by Recruitment Select to you.
Advertisers may not assign or transfer any rights and obligations pursuant to this agreement to any other person or entity without the prior written approval of Recruitment Select (which will not be unreasonably withheld). If you are a company, any change in your effective control shall be deemed an assignment for the purpose of this clause.
Advertisers agree that Recruitment Select retains all intellectual property rights contained in any of the goods and services provided to you by Recruitment Select.
Advertisers acknowledge and agree that Recruitment Select acts as a medium through which individuals seek employment opportunities and that Recruitment Select does not vet nor is it responsible for vetting job candidates or the representations (whether oral, in writing or by any electronic form of communication) made by them.
Recruitment Select disclaims all liability for any loss, costs, damages or loss of profits sustained as a consequence of any advertiser employing or engaging any person sourced through the Recruitment Select site.
Advertisers agree to comply with the national privacy principles set out under the privacy amendment (private section) act 2000 see www.privacy.gov.au for more information on the Australian npp´s.
Advertisers agree to comply with section 53b of the trade practices act 1974 (c´th) which requires that advertisers that are companies not mislead persons seeking employment as to the availability, nature, terms or conditions or, any other matter relating to the employment opportunity being offered.
Recruitment Select provides links to other internet sites maintained by third parties. Linked sites are not under the control of Recruitment Select and Recruitment Select is not responsible for the contents (including the accuracy, legality or decency) of any linked site or any link contained in a linked site.
The inclusion of any linked sites on the Recruitment Select site does not imply endorsement by Recruitment Select of the linked site. Recruitment Select is not responsible for the copyright compliance of any linked site. Recruitment Select will not be liable for any damages or loss arising in any way out of or in connection with or incidental to any information or third party service provided by any third party.
While Recruitment Select takes due care in ensuring the privacy and integrity of the information provided by advertisers, the possibility exists that this information could be unlawfully observed by a third party while in transit over the internet or while stored on Recruitment Select’s systems or on Recruitment Select’s site. Recruitment Select disclaims all liability to advertisers to the greatest extent possible pursuant to law should this occur.
If in Recruitment Select’s reasonable opinion any job posting is likely to infringe upon any of the warranties and representations in the stipulated terms and conditions, then Recruitment Select may without prejudice remove that job posting and any related information.
Recruitment Select welcomes feedback from users about our site. Users agree that Recruitment Select may reproduce or create derivative works of, and publicly display any materials and other information (including ideas for new or improved services) that users submit by email to Recruitment Select.
Recruitment Select may modify this agreement at any time, and such modifications shall become effective immediately upon posting of the modified agreement on the site.
If any part of this agreement is held invalid that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable.
Termination of this agreement does not end those provisions that are capable of surviving the ending of this agreement.
The laws governing this agreement will be the laws in Victoria, Australia and advertisers irrevocably submit to the exclusive jurisdiction of its courts and its appellate courts and the jurisdiction of the federal court of Australia sitting in Victoria.
For the purposes of this agreement the words "Recruitment Select", "we", "our" and "us" refer to Recruitment Select and "site" to materials delivered on www.recruitmentselect.com.au . Information supplied by employers is only made available to jobseekers who are auto matched to the vacancy listed by the employer or to jobseekers who are selected by the employer as a potential employee.
Employers should note that this site makes no guarantees either explicit or implied to place jobseekers into their vacancies. Recruitment Select provides an introduction between jobseekers and employer’s vacancies. Employers will choose which jobseekers they wish to further consider for their vacancies either after jobseekers are automatched to their vacancies or they have searched and chosen jobseekers they consider suitable. Jobseekers are not obliged to take up a position offered to them by an employer even if it in all respects matches their stated location, industry sector and time frames.
Once an employer wishes to make contact with a jobseeker they will be given the contact details of the jobseekers and it will be up to the employer to make contact with and obtain any further information, make an offer of work and agree on commencement and employment arrangements with the jobseekers.
Recruitment Select makes no guarantees or warranties about the legality or otherwise of any particular jobseekers to work in Australia. Jobseekers are advised upon registration that if they are not an Australian citizen they must hold and produce to employers the appropriate visa endorsement allowing them to work in Australia when they register for employment with any Australian employer. Employers are able to access the department of immigration website at http://www.immi.gov.au/immigration.htm to check which class of visa holder are eligible to work in Australia. It is an employers responsibility, to check the bona fides of any staff they employ.
By ticking the "I accept terms and conditions" box below, the employer is accepting the terms and conditions of use of this site and specifically authorises Recruitment Select to release both non identifying and identifying information to potential jobseekers in line with the condition.
